Staging legal terms
Fishery partner terms
Business terms for organisations listing fisheries and taking bookings through Dayticket.fish.
Last updated: 22 August 2026
1. Agreement and authority
These business-to-business terms are between Bad Otter Ltd (“Dayticket.fish”) and the organisation accepting them (“Fishery”). The person accepting confirms they are authorised to bind the Fishery. The commission schedule, any agreed commercial override, data terms and policies referred to in the account form the agreement.
2. Platform role and Fishery role
Dayticket.fish provides listing, booking, payment, ticketing and management technology. The Fishery is the principal and trader supplying fishing access to anglers. The Fishery appoints us as its disclosed booking and payment agent to conclude bookings and collect amounts through the configured payment provider on its behalf. We do not own, occupy, inspect or operate the Fishery.
3. Onboarding and account security
The Fishery must provide accurate legal, contact, tax and payout information; complete payment-provider verification; keep authorised users current; and protect credentials. We may verify identity, authority, ownership, bank details and venue information before activating bookings or changing payouts.
4. Listings, availability and customer contract
The Fishery controls and is responsible for accurate descriptions, prices, availability, capacity, rules, age limits, accessibility, access instructions, safety information and cancellation policies. It must honour confirmed bookings, avoid misleading claims, keep inventory current and promptly tell us and affected anglers of material changes. The Fishery must provide services with reasonable care and skill and comply with applicable law.
5. Commission and payment processing
The standard Dayticket.fish fishery model has no setup fee and no monthly subscription. Unless a written fishery-specific override applies, platform commission is calculated progressively on monthly gross booking value: 5% on the first £1,000, 4.5% on the portion from £1,000 to £2,500, 4% on the portion from £2,500 to £5,000, and 3% on the portion above £5,000. Crossing a threshold does not reprice earlier turnover in that month.
Payment-provider processing fees and applicable taxes are treated separately as shown in the Fishery account or agreed commercial terms. Specialist operating models, including holiday-site fishing or accommodation supply, may use a separately agreed commission schedule. A written account-level override supersedes the standard rate for its stated period. We will give reasonable advance notice of future commission changes; changes do not alter confirmed bookings.
6. Features
Standard fishery functionality is included for every Fishery under the commission-only model. Some specialist operating models, integrations or regulated workflows may require separate configuration or eligibility, but standard product functionality is not withheld in return for a recurring subscription.
7. Payments and settlement
Payments are processed through the configured provider and may be routed to the Fishery’s connected account net of applicable platform commission and provider fees. Settlement timing depends on provider rules, verification, banking systems and risk checks. The Fishery authorises deductions, reversals or set-off for refunds, chargebacks, disputes, errors, fraud, taxes and sums it owes under the agreement.
The Fishery remains responsible for its taxes and accounting. Reports are operational records, not tax advice or guaranteed bank statements.
8. Cancellations, refunds and disruption
The Fishery must publish a fair, clear cancellation policy and apply it consistently, subject to law. If the Fishery cancels, it must promptly offer the remedy configured and communicated to the customer. The Fishery authorises Dayticket.fish to process approved or legally required refunds and recover the corresponding amount and reversed commission where applicable.
9. Customer support and complaints
The Fishery handles venue, service, access, rules and on-site complaints. Dayticket.fish handles platform, payment and ticket-technology support. Each party must cooperate, preserve evidence and respond promptly.
10. Data protection
Each party is an independent controller for personal data it uses for its own purposes. The Fishery may use booking data to fulfil and administer bookings, meet legal obligations, ensure venue safety and provide legitimate customer service. Where Dayticket.fish processes personal data solely on documented Fishery instructions, it will apply applicable UK GDPR processor obligations.
Our privacy notice explains platform processing to individuals.
11. Content, reviews and intellectual property
The Fishery retains ownership of its content and grants us a worldwide, non-exclusive, royalty-free licence to host, adapt and display it for operating and promoting the platform and its listing. We own the platform, software and Dayticket.fish branding.
12. Acceptable use and suspension
The Fishery must not misuse the platform, bypass commission, create false availability, misuse customer data or facilitate illegal activity. We may suspend features, listings, bookings or payouts proportionately where needed for security, unpaid amounts properly due from completed transactions, legal compliance, serious customer harm or material breach.
13. Availability and changes
We will provide the service with reasonable care and skill but do not promise uninterrupted availability. We may improve or change features while preserving the standard platform proposition or giving reasonable notice of a material adverse change. Beta or staging functions may change or be withdrawn.
14. Liability and insurance
Neither party excludes liability that cannot lawfully be excluded. The Fishery is responsible for the venue and services it supplies and must maintain appropriate public liability and business insurance.
Subject to applicable law, Dayticket.fish’s aggregate liability in a 12-month period is limited to the greater of £500 and the platform commission paid or payable by the Fishery in that period.
15. Term, termination and exit
The agreement begins on acceptance and continues until ended. Unless a separate written agreement says otherwise, either party may end the relationship on 30 days’ notice. Termination stops new bookings but does not cancel existing customer contracts, accrued commission, refunds, disputes or duties intended to survive.
16. General
Confidential information must be protected and used only for the agreement. The agreement is governed by English law and the courts of England and Wales have exclusive jurisdiction for business disputes.
